Criticism of Patriot Act Essay Example

Criticism of Patriot Act Essay Example Criticism of Patriot Act Paper Criticism of Patriot Act Paper The passing of the USA Patriot Act into law was a mistake for this nation. The key provisions of the Act include enabling law enforcement agencies access to private information, strengthens the Treasures to power over financial regulations, and encourages immigration authorities to detain and deport immigrants all In an effort to circumvent terrorist activity. The post-WI 1 hysteria was all lawmakers needed to hurriedly pass an act that claimed to be all for the protection of this nation, but If more time had been spent reading between the lines the Act may not have been passed. It was passed under the comforting name of the Patriot Act but the rights granted by the Act violate a multitude of the rights valued by the people of the nation. I believe the Patriot Act Is a tool that grants a gross overstepping of power that will cause more trouble than It will prevent. I believe the passing of the Act puts our nation on a slippery slope wherein our Democratic society morphs Into one of Totalitarianism. In the united States, freedom and privacy are our basic rights, but when terrorism threats the country, it seems counterintuitive for the country to pass an Act that heartens the rights its own people. The ideas of the Constitution should never, under any condition, be compromised not even in times of crisis. I believe the deeming of a national crisis is a job that can only be performed by the President, only after evaluating the reaction of the public after a crippling event. By compromising the ideas of the Constitution with this Act, it sets a precedent that will allow future expansions of power to be granted easily. Eventually, it will become unclear where to decide how much power given to agencies is too much. Attempting to indemnify terrorists by riffing through private information is as effective as finding a needle in a haystack. Since its passing, no terrorist has been caught under the Act but rather cases of mistaken accusations have been made. Not only is it ineffective, but embarrassing. The United States prestige as a shining example of Democracy will be tarnished by our aimless and futile factorization. The Act has good intentions but is not the best way of protecting the nation. In place of the Patriot Act should be one that doesnt randomly target people, but one hat requires stricter security measures for procedures already In place. That way, fewer things will slip past authorities ensuring safety. The only thing that the Patriot Act can ensure is not society living In a state of safety but rather living In a state of fear. Criticism of Patriot Act By Gingerbread information, strengthens the Treasurys to power over financial regulations, and encourages immigration authorities to detain and deport immigrants all in an effort hurriedly pass an act that claimed to be all for the protection of this nation, but if nation. Analytical Report Employee Behaviour and Working Relationships

The study paper has been described to discuss the management of one of the fundamental business ethical dilemmas. Precisely, contemporary business organisations need to identify the foundational issues related to business ethics, so that management of workforce will become effective. In the management of employee behaviour and working relationships, one of the most conventional ethical dilemmas is manager’s role in dealing with the claims of workplace harassment. Through the identification of the particular business ethics dilemma, the study considers moral reasoning and significant ethical principles describing the issue from a broader perspective (Dale, 2016). Moreover, the issue has been discussed at the individual level, organisational level, and corporate social level to define the impact on the same based on moral stance. Notably, the critical analysis of the identified issue has been illustrated in the study based on the question of morality and challenges to be considered by modern firms. However, the importance of ethics to the contemporary business management must be evaluated at the individual, organisational, and corporate social level. Dealing with the issue of ethical dilemmas such as workplace bullying or harassment claim management in the management of employee behaviour and working relationships, the role of the manager should be evident. Meanwhile, ignoring the workplace bullying or workplace harassment cases can create an adverse impact on the employee engagement and reputation of the firm (Teare, 2016). Modern organisations need to identify the essence of employee relation management so that any internal ethical issues can be dealt with severity. Precisely, the management of the human resource must protect the civil rights of the employees to avoid issues leading to discriminatory harassment due to gender, religion, race, colour, and employee background, etc (O'Leary-Kelly and Bowes-Sperry, 2001). In order to control the problems of managing workplace bullying and harassment claims, suitable organisational ethical code of conduct and employee regulations must be developed. By considering the law of discrimination, such ethical problems should be tackled irrespective of any other aspects (Armstrong and Francis, 2014). However, the manager needs to investigate the impact of the issue at the broader level so that the damage control must be done quickly. For instance, some of the reputed companies have tried to solve the issue internally so that the overall status and reputation of the business cannot be hampered (Stevens, 2010). Herein, the ethical liability of the company should be questioned. Furthermore, in dealing with the ethical dilemmas such as workplace bullying and harassment claims in managing employee behaviour and working relationships, the management team needs to verify each aspect of the problem as the issue can affect the employment of an individual employee (McCabe and Hardman, 2005). Apparently, the ethical code of conduct and workplace guidelines must state the employees what actions should be acceptable within the workplace. Understandably, workplace bullying can destroy the entire culture of the business organisation. For a manager’s point of view, in the decision-making of a harassment claim, it is important to investigate the type of humiliation involved in the case. Proper investigation and evidence must be conducted so that the emotional stress of the plaintiff can be redeemed (Lieber, 2008). However, certain challenges must be overcome by the managers dealing with the issues of managing harassment claims and workplace bullying. One of the most significant challenges in managing the cases of workplace harassment is the position of the accused. In many of the instances, the senior executives have been accused of the harassing the staff members based on sex, gender, race, or religion, etc (Fevre, Grainger and Brewer, 2010). Therefore, managers may face significant administrative pressure to handle the case internally. As a result of the consequences, independent investigation and witness related to the case can be manipulated. Alternatively, in the case of sexual harassment claims and other discriminatory cases, responding to the complaints has been delayed so that the severity of the matter cannot affect the culture of the organisation (Hirsh and Lyons, 2010). However, in the management of employee behaviour and working relationships based on moral and ethical aspects, managers need to evaluate what is right according to the stated ethical code of conduct. The decision-making standards of the manager need to distinct the practice of workplace romance and sexual harassment so that the accused employee can get the right punishment for the offence (Boland, 2005). By listing the inappropriate behaviours that can be considered as workplace bullying, managers of the modern firms can ensure right practices while handling such cases of harassment claims (Thrasher et al., 2016). If an employee has been found guilty, legal actions should be taken to set an example. The ethical dilemmas have several implications of the organisation at different levels. For example, the individuals facing the harassments are directly impacted by the issues. On the other hand, the managers as a representative of the organisation need to deal with the issues or uncertainties (Trevin?o and Nelson, 2011). Furthermore, the ethical issues may result in loss of reputation of the organisation among the external stakeholders of the firm. Hence, it is important for the HR department to maintain separate policies and strategies to deal with the ethical dilemmas to smoothly carry on the operations of the firm. The influence of workplace harassment in different levels have been analysed in details in the below section. It is a responsibility of a person to work according to the policies of the organisation and to help others working in a safe and secured environment. Furthermore, in the management of employee behaviour and working relationships, the role of the managers is to provide a better working condition to the employees in order to improve their performance. The ethical dilemma of workplace harassment management has several negative impacts over the individuals who face such issues. On the other hand, it impacts the morality of the surrounding people working under the same condition. The effect of harassment over an individual may range from simple frustration to extreme depression (O'Leary-Kelly and Bowes-Sperry, 2001). The subjects of these types of behaviours often lose their morale and self esteem. Moreover, the incidents may lead the subjects to frequent disruption and make them unable to concentrate on their jobs. The issues of workplace harassment may lead to inconsistent timekeeping, lack of commitment, increased absenteeism. On the other hand, low performance may even lead to resignation (Trevin?o and Nelson, 2011). Additionally, anxieties can also be noticed in the life of the victims as well as their family.   It can be seen through study that irrespective of different HR policies and strict government regulations, several cases of workplace harassment can be seen throughout the globe. Hence, the development of policies and ways to handle the situations will not be the ultimate way to mitigate the issue. The management must focus on developing the mindset among every individual in the workforce to influence people committing such nuisance (Trevin?o and Nelson, 2011). In context to the impact of workplace on the organisational level, the reduced morale and self-esteem of the employees directly influences the affectivity and performance of the organisation. The cases of workplace harassment impact the motivation and satisfaction level of the victims (Thrasher et al., 2016). On the other hand, the cases of ethical dilemmas also influence the surrounding employees who are not directly connected to the issue. Workplace harassment leads to high employee turnover, absenteeism, reduce productivity, lose of initiative, lack of creativity, and lack of performance (Oyewunmi, 2013). Hence, the issues of harassment lead to negative impact over the organisation and its internal reputation. Precisely, by admitting consequentiality theory of morality and ethics, responsibility towards the employees should be protected and promoted by the management of any organisation. Such theoretical aspect will influence the decision making of the managers dealing in claims o f workplace harassment. It is important for the managers to deal with the cases of workplace harassment on a serious note. The managers act as a representative of the organisation and must help the employees facing such problems. It is the duty of the managers to promote people to come up and speak to the management regarding such issues (Perry, 2013). On the other hand, the personal feelings of the managers must not interfere with the objectives required to handle such problems in the organisation (Geppert and Roberts, 2007). Hence, it is important for the managers to maintain good relationship with the workforce to know every detail of the daily operations and avoid the occurrence of such ethical dilemmas in the workplace. By setting poor examples of ethical disputes within the business environment, the upward success graph of the corporate business can be cut short. Precisely, failure to control the ethical issues within the corporate management, organisations can face substantial challenges such as legal issues, employee performance, employee relations, and credibility issues in business dimension. Following the duty theory of ethics, foundational principle must be taken into consideration by the management to deal with the cases and claims of harassment within the organisation. The duty theory promotes right things first irrespective of any situation. During the management of sexual harassment scandals or humiliation of employee, company guidelines and legal directives should be followed at the highest level to protect the corporate social dignity of the enterprise. If the management of modern firms have failed to mitigate the workplace harassment cases, scandals regarding harassment issues can dire ctly make an adverse impact on the organisational status as well as financial position of the company (Fevre, Grainger and Brewer, 2010). Due to such ethical issues and controversies, the stakeholders and investors may have lost their faith on the company. As a result of the scenario, the overall business proceedings can be diminished. At the same time, if such ethical issues cannot be handled according to the law and directives, a negative message can be sent to the rest of the workforce. Therefore, the intensity and employee engagement at the work will be reduced. Thus, the employee productivity will be affected as well. Furthermore, failure to deal with such ethical dilemmas can adversely affect the employee relations. Unethical behaviours in the workforce can increase tension among the employees. Thus, the collaboration and dedication within the workforce will reduce in a substantial order. On a broader perspective, failure to manage the workplace bullying and other harassment cases can be a huge setback towards the business credibility of the firm (Faldu, 2012). Due to lack of ethical guidelines, the organisation may have lost their target audience. Meanwhile, the impact of such event will be substantial in the business framework. Also, the consumer confidence towards the organisation will be reduced as well. On the basis of the above analysis, it is important for the management of every organisation to take necessary steps in order to mitigate the ethical dilemmas and develop a healthy and safe workplace for the employee. Some recommendations have been discussed herein below to deal with the problems of workplace harassment: By considering the above analysis, the management is responsible for maintaining the organisational behaviour and promote corporate culture in the firm. There are several cases of workplace harassments that are faced by the organisation that directly impacts the productivity and reputation of the firm. On the other hand, the issues of workplace harassments lead to anxiety in the life of the victims and their family. Hence, it is the duty of the managers to promote ethical practices in the firm by developing adequate HR policies and introducing appropriate training and development programmes. Conclusively, the management must take necessary steps to manage the ethical dilemmas to maintain a safe and health workplace for the employees. Armstrong, A. and Francis, R. (2014). Management case study applying 10 management theories

Management applying 10 management theories - Case Study Example Bearing in mind that the traditional methods of competitive advantage may not apply to the modern business sector, market segmentation and appropriate targeting can also act as a competitive advantage. However, to take advantage of this, the organization ought to devise reliable ways of undertaking market research, which requires the right employees who can only be acquired through recruitment and selection. Although the organization may decide to undertake internal recruitment, it is usually recommended to undertake external recruitment through advertisements, referrals, and the Internet. This provides a new set of skills for the organization that can be used to capitalize on market segmentation and targeting. In spite of this advantage, this also requires additional resources that mean additional expenses that organizations take lengthy discussions to deal with. To accomplish the required outcomes, the organization ought to understand the impact that rational decision making can have towards the realization of this quest. Rational decision making incorporates several steps that begin with the identification of a problem, formulation of alternatives, implementation of the most appropriate solution, and evaluation of the impact that the implemented solution has. In most cases, this process favors logic, analysis as well as objectivity. Since marketing is an issue in the organization, as indicated in the case study, this provides information on the problem to be resolved while the next step would involve several alternatives that may include increasing supply or even identifying areas to supply specific products. This is because the research would provide information concerning customer preferences, which is very important to organizations. Once the most appropriate step has been agreed upon and implemented, the final step is very important

Arab and israeli conflict Essay Example | Topics and Well Written Essays - 750 words

Arab and israeli conflict - Essay Example Evidently, this changed leading to a series of conflicts that are still being experienced today. Podeh (27) reveals that after the collapse of the Ottoman Empire, both the Arab and the Israeli aimed at occupying the empire; as a result, there was a political and nationalist conflict between Arab and Israeli over territorial competition. The conflict then spread to the local Israeli and the Palestinians. The conflict between Arab and Israeli was based on different aspects. There was religious aspect where by Muslim, Jewish and the Christian argued about the idea of the chosen people. Both sides claim to have full right to take the land of Canaan. The Israeli people claim that the land was for the children of Israel as promised by God according to the bible. The Arabs, on the other hand, claim the same land in accordance to their Quran. The Arabs argue that the land of Canaan was promised to all of Abrahams’ descendants including Ishmael. Arabs claim descent from Ishmael hence they had to fight for the land of Canaan. Despite a number of peace agreements between Arabs and Israeli, the conflict has moved from bad to worse. The two conflicting parties have involved into wars of which the Israeli defense force has won most of them. Throughout the conflict period, the Israeli government is positive at the conflict negotiations with their rivals Arabs. The conflict is one of a kind having lasted for almost six decades. Podeh (34) asserts that America has been in the front line to help in resolving the conflict between Arab and Israeli. The United States provides defense to the Israel against the common threats of the radical Islam and the terroristic activities. America has significantly promoted peace to the Arabs and Israelis by allowing the Israelis to take greater risks for peace. United State has also helped the government of Israeli to retain back many of its immigrants America being a superpower nation, it has

The Comparison and Contrast of I Wandered Lonely as a Cloud & The Prese

‘I Wandered Lonely as a Cloud’ and ‘The Preservation of Flowers’: two notable poems, two very different styles of writing. This essay will look at their contrasts and similarities, from relevant formal aspects, to the deeper meanings hidden between the lines. We will look at both writers use of: rhyme scheme, sound patterning, word choice, figurative language and punctuation. The essay will also touch a little on the backgrounds of the writers: themselves, and their inspiration, with the intention of gaining a greater understanding of both texts. The structure and form of both poems is evidently dissimilar. Wordsworth’s poem follows a clear rhyme scheme: ABABCC; and contains four stanzas of six lines each. In each stanza, the first line rhymes with the third, the second with the fourth and the stanza concludes with a rhyming couplet. Bird’s sixteen line- narrative verse does not follow any formal rhyme scheme. She describes full rhyme as being â€Å"too strident†E1 for her personal taste. Choosing instead: to use consonance and near rhymes. Despite this seemingly unconventional style with which the poem is written, it does follow an iambic pentameter, with every line containing five stressed syllables, except line 13 which contains six. ‘Cer-tain cus-to-mers, he slips an ex-tra rose’13. This is a very clever play on words, using the term ‘extra rose’ to mirror the extra syllable in the line. This patently demonstrates Bird’s astute understanding of structure and form. She explains – â€Å"There's a poetry joke in there too - each line has five stresses, but the 'extra rose' line has six stresses. An extra rose, an extra stress.†E2. This again presents another parallel to Wordsworth’s lyric, where the meter is not u... ... he has a point. Contrary to this statement however, there remains the reality: that without dissection and close analysis, the true meanings encoded within these two texts, might remain perpetually esoteric. Shouldice Hospital, Ltd. Case

Starting as a small hospital, the Shouldice Hospital has had a rather long history since the end of the Second World War. And At the time of his death in 1965, the founder Dr. Shouldice’s longtime associate, Dr. Nicholas Obney was named surgeon-in-chief and chairman of the board of Shouldice Hospital Limited and under his leadership, the volume of activity continued to increase, reaching a total of 6,850 operations in the 1982 calendar year. And primaries represented approximately 82% of all hernias operations performed at Shouldice in 1982.It has been very successful. And now it tries to meet people’s needs and make this as good a place to work as possible. It has been a comfortable place for patients to stay. During their stay, patients were encouraged to take advantage of the opportunity to explore the premises and make new friends. Also, it has been a nice place for doctors who teach each other, encourage a group effort, have regular working hours and own desirable salary. Furthermore, the facility and administration here is very humanized for both patients and staff. As a result, patients are attracted to the hospital by its reasonable rates. Shouldice Hospital has specialized in hernia surgery (the Shouldice method) and is able to provide patients with low risk, low recurrence, and peace of mind. Shouldice achieves outstanding results as a low price and at high profit because everything done by the hospital is designed to maximize the difference between perceived quality and the value of the service provided to the patients on one hand and the cost of providing the service on the other. They do this by carefully screening patients.Patients are active participants in the service delivery process as presented with the utensils to prep themselves for surgery. The avoidance of general anesthetics allows a wide range of involvement of patients. The staff is freed from much of the disagreeable workload due to part-time positions. The cost of housek eeping, laundry, and food is also minimized. The clinic structures hospital jobs that involve more counseling and positive interaction with the patients. Shouldice Hospital is different from other hospitals in that Patients do not feel that they are staying in a hospital. It is Shouldice’s intentions to make its patients feel as if they are taking a vacation. When patients arrive to the clinic, typically they join up with 30 to 34 other patients and their friends and families in the waiting room. Patients with similar jobs, backgrounds, or interests are assigned to the same room to help the patients establish relationships and become more comfortable. The facility is also designed so that patients have to interact and walk around. There are no televisions are telephones in the patients’ rooms. This gives the patients the opportunity to tour the facility, visit each other’s rooms, lounging in the Florida room, and making use of the light recreational facilities. Sh ouldice Hospital uses a focus strategy. The Hospital’s market focus is on a narrow segment of potential patients who have a hernia and the patients are predominantly male, older in age, and essentially in good health. The hospital has knowledge of the large target market, as there were 600,000 such operations in the United States in 1979. Shouldice uses an internal market strategy.Shouldice’s doctors are dedicated to quality of the Shouldice method. The doctors are after several years at Shouldice must decide if this is something they want to do for the rest of their lives because eventually they will lose touch with other medical disciplines. Few elect to leave. Nurses at the facility are people oriented and work to assist patients as well as they can. The Staff is flexible and team oriented. Shouldice implements a sharing policy where the employees are paid a part of the profit in addition to their fixed salaries. This sharing is done based on their contribution towar ds the success of the firm. This entices them to work hard and put in more efforts. From the management point of view, they have given their staff a lesser work load and weekends off. This makes it able for the staff to spend more time with their families and keeps them content with their jobs. After discussion, our group has four suggestions for Shouldice Hospital in terms of their problem. First, author mentions that there are some people realize that they don’t have hernias when they talk to doctor in hospital. Therefore, hospital can increase its capacity by reduce this kind of error. Our group suggests that hospital should improve its questionnaire to make sure consumer can totally understand the questions. If there are some uncertainties in the questionnaire, nurses or doctors should call individual to make sure he/she has certain external types of abdominal hernias. Secondly, we think that Shouldice Hospital should not operate on Saturday. Even through Saturday operatio n can increase capacity by 20%, it is hard to control the operation quality. As O’Dell said† On the other hand, I'm oncerned about this talk of Saturday operations. We are already getting good utilization of this facility. And if we expand further, it will be very difficult to maintain the same kind of working relationships and attitudes. Already there are rumors floating around among the staff about it. And the staff is not pleased. † Right now, Shouldice hospital is much more efficient and effective than other hospital. We believe they make excellent utilization of their resource. Therefore, Saturday operation may cause some overload on hospital’s capacity which will jeopardize the current process flow.Thirdly, we believe that offers similar opportunities such as eye surgery is not a good idea. The reason is that the business bottleneck of Shouldice Hospital is the capacity of process rather than the demand in market. So, they should focus on how to impro ve the capacity to service more patients. Moreover, offering other surgery may harm their professional image in hernias area. Hence, our group suggests that they just stay on the hernias field and try to extent capacity. Fourth, we strongly suggest that Shouldice Hospital should build another hospital in the United States.Nowadays, 42% of their patients are come from the United States. Round-trip fares for travel to Toronto from various major cities in the North American continent ranged from roughly $200 to $600, as compare that the total operation fee including hospital is just around $1000. So the travel cost becomes a big financial burden for patients. Hence, open a new hospital in American will dramatically reduce the travel cost for customers and expand business. There are two big issue concerns with the new hospital, where to open and how to operate. Our group proposes that Shouldice Hospital should conduct a marketing research to find out where their current American patient come from and the transportation for some big city in United States to decide where to invest new hospital. About the operation of new hospital, quality control is the most important issue to maintain our brand reputation. They should relocate some experienced doctor from Toronto to American to train and direct the local doctor. Moreover, they should utilize the successful process flow into the new hospital and make some change by considering the difference culture and condition. Finally, Shouldice Hospital should be marketing their service, while the main strategy of marketing is to clarify where is hospital and what kind of operation is truly theirs. Because there are many individuals or institution on the market want to attract customers by using our brand image. But, the quality of their service is not very good. This phenomenon will jeopardize our brand image and destroy our reputation. It is the responsibility of hospital to help people distinguish the fake one. Our group belie ves that some marketing activity will well-build hospital’s brand image and help them success in the long-term.

Irresponsible Passions By Alan Pell Crawford - 1584 Words

Unwise Passions by Alan Pell Crawford, first starts by introducing the issue that this novel is centered around, Richard Randolph and Nancy Randolph. Who were accused of killing â€Å"their† child in the middle of the night, a child created out of wedlock who was buried in the backyard. As the novel opens up, it introduces the two families caught in the middle of this controversy. Nancy Randolph was born Anne Cary Randolph, named after her mother and was born on September 16, 1774 at her family’s plantations. Colonel Thomas Mann Randolph and his wife had a total of thirteen children, six boys and seven girls. The Randolph family were great friends with the Jefferson family because of Nancy’s grandfather who implored his good friend Peter Jefferson to assist his son with the plantation upon his death; this resulted in the Jefferson family living on the plantation for seven years. The Randolph family descended from the John Rolfe and Pocahontas relationship which is something that they took great pride in. Around the summer of 1788, Judith and Richard fell in love leading Richard to ask for Judith’s hand in marriage. The couple simply waited for Judith’s mother to change her mind of her disapproval on the marriage, however; Ann Carry died before this could happen and the couple married at the age of seventeen and nineteen. Soon Nancy’s father could no longer stand being a widower and decides to marry Gabriella who at the time was the same age as Nancy. The two couldn’t get along
